Judge commits East Village man to state mental hospital for fatal stabbing
An East Village man who repeatedly stabbed his downstairs neighbor whom he had never previously met has been committed to a state mental hospital after a judge determined he was insane at the time Several family members of the victim Andrew Holland appeared before San Diego Superior Court Judge Frances Devaney who committed Maxwell Thomas Logan to a state hospital possibly for life Under California s insanity law Logan pleaded guilty to second-degree murder in a trial before Devaney It will be up to Logan to prove that he has regained his sanity should he ever petition a court for release The prosecution and defense submitted numerous psychiatric documents for the judge to read and Devaney later uncovered that Logan was not guilty because of insanity which means he will serve his sentence in a mental hospital Holland was inside his th Ave apartment on Aug and left his door open because it was a hot August night At around p m Logan walked into Holland s apartment without warning and stabbed him to death We will never stop missing him We will never stop loving him announced the victim s mother Jan Holland to the judge It is a relief to know that Mr Logan has been incarcerated the last months and will continue to be locked up Maxwell we want you to know that we forgive you reported Holland s mother We pray you make every effort to become a better person We will continue to pray for you and your family This can t happen again and the only way to know you won t do it again is for you to be committed to this asylum for the rest of your life stated Tim Holland a brother of the victim During Andy s celebration of life ceremony he had family and friends who traveled from all across the United States It was a heart-wrenching evening but filled with much love disclosed his sister-in-law Melissa Holland His friends spent hours talking to us and sharing what Andy meant to them I have stood in the very spot where Andy took his last breah and I have had to stop my mind from thinking about his final moments added another brother Stephen Holland The moments when a large man stood over my brother and decided to end his life What you have stolen from this family should not go without consequence Devaney gave Logan credit for serving days in jail according to court records The prosecutor could not be reached for comment afterwards
